What is a Guardianship Will?
Legal Guardianship Will is an important document which should be seen as an extension of the protection you give to your children during your lifetime. If you (the parents) die while the child is under 18 years of age, the State will have no other option but to hand over the child to the foster care.
Facts
Do you know that in England, 55,200 children were living with foster families on 31 March 2018, this is nearly four-fifths (78%) of the 70,720 children in care looked after away from home. There are around 43,500 foster families in England (2018 Survey).
Do you know that in 2016, there were 181,384 accident casualties recorded on Britain's roads.
Do you know that online Survey shows also that by the age of 16, around 1 in 20 children will have experienced the death of one or both of their parents. Without a guardian appointed in your will, you don't get a say in who would take care of your child. Making a will is the only legally binding way to decide who you'd like your child's guardian to be.
What if there is no Legal ‘Guardianship Will’?
Everybody needs a Will, but there is one group for whom a Last Will and Testament is invaluable – parents of young children.
Through Legal ‘Guardianship Will’, parents can decide who should care for their children, if they die.
By not having a Guardianship will, Parents are unwittingly putting their children at risk of court-battles, family disputes and potentially even foster care.
Don’t put the burden on the Court to decide a Guardian for your children, as the Court is limited by the laws and the Court doesn’t know about your priorities. It is very difficult for a judge to consider intangible attributes like political or religious views, child raising values, integrity and ambition.
